OFFICIAL CONTEST RULES AND REGULATIONS
The Coloring Book Contest (the “Contest”) begins at 7:30pm PST, August 29, 2015 and ends at 6:00pm PST, September 3, 2015 (the “Contest Period”). The contest is sponsored by Brit Media, Inc. (the “Sponsor”). The Contest and all entries, including the design submissions, are subject to and governed by the Sponsor and its Terms of Service, Privacy Policy and the additional terms herein. By entering this Contest, you agree to abide by the terms of these Official Contest Rules and Regulations (the “Contest Rules”) and by the decisions of Sponsor, which are final and binding on all matters pertaining to a contest. In the event of a conflict between the Terms of Service, Privacy Policy, the terms or conditions of a third party service provider (including, but not limited to, 99designs.com), and these Contest Rules, the Contest Rules shall govern.

HOW TO ENTER: To enter, go to Sponsor website at https://www.brit.co/brit-co-coloring-book-submit-designs/ (the “Contest Site”) or mobile application during the Contest Period, register for the Contest by clicking on the Submit your design here link and following the instructions. Each entrant may submit as many designs as they chose. Participation in the Competition is voluntary and does not require you to purchase anything from the Sponsor. No illegible, incomplete or forged entries will be accepted. All entries become the property of the Sponsor and no entries will be returned.
OWNERSHIP/USE OF ENTRIES: By submitting an entry, you agree that the Sponsor and its designees have an unlimited, worldwide, perpetual, license and right to edit, publish, use, adapt, exploit, modify, copy, disseminate or dispose of any entry, the design concepts embodied therein or any elements thereof, online, in print, film, television, social media, consumer products, and/or in or in connection with any other media now known or hereafter devised, for any purpose, worldwide in perpetuity without compensation or notification to or permission from the participant of any kind, except as otherwise prohibited by law.
ELIGIBILITY: Contests are only open to adults who are at least 18 years of age at the time of entry and have a valid email address. Any person who, at any time on or after August 30, 2015, was or is a director, officer, or employees of Sponsor as well as their immediate family members and/or persons living in their households; as well as all of Sponsor’s agents, affiliates, subsidiaries, divisions, advertising and promotion agencies are not eligible to participate in any contest. Entrants who do not comply with these requirements or these Contest Rules are not eligible to compete or win a prize. NO PURCHASE NECESSARY TO ENTER OR TO WIN. ALL U.S. FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID IN TERRITORIES PROHIBITED BY LAW.
CONTEST PERIOD; DEADLINE: The Contest begins on 7:30pm PST, August 29, 2015 in the United States and ends on 6:00pm PST, September 3, 2015 (the “Contest Period”). All dates are subject to change. Sponsor’s clock is the official timekeeping device for this Contest.
CONTEST CRITERIA: Designs submitted in connection with this Contest must include a black and white line drawing submitted as a .jpeg or .eps vertical layout within the theme of “pattern play” as described further after clicking on the submit your design here link in the post at “Contest Site.” Sponsor may reject any inappropriate designs at its sole discretion. Winner(s) will be selected among all eligible entries based on satisfaction of the Contest Criteria, composition and overall quality, creativity, originality, and overall impression. By entering a contest, entrant warrants that he or she is the sole designer, creator, and legal owner of the entry, including all visual components, and that the work does not contain, incorporate or otherwise use any content, material or element that is owned by a third party or entity, or that violates a third party’s publicity, privacy or intellectual property rights. Entrant must have obtained all necessary releases from any persons or related to any subject matter appearing in each entry. Sponsor can change the Contest Rules at any time.
SELECTION OF WINNERS: The Sponsor, in its sole and absolute discretion, will select at minimum one design from from among the eligible entries based on satisfaction of the Contest Criteria, compliance with these Contest Rules, composition and overall quality, creativity, originality, and overall impression. Decisions of the judges are final and binding. If a potential winner is unable for whatever reason to accept his or her prize, the Sponsor reserves the right to award the prize to another entrant.
WINNER NOTIFICATION: Sponsor will notify each potential winner within ten (10) business days after the end of the Contest Period via e-mail to the winner’s registered e-mail address (the “Winner Notification”). A winner must respond to the Winner Notification from his/her registered e-mail address within 24 hours of receipt of the Winner Notification and, in order to be eligible to accept a prize, must include in such response: (i) winner’s full legal name, (ii) current residential mailing address, (iii) phone number, and (iv) date of birth. If a winner fails to respond to the Winner Notification in the time and in the manner required, or if a Winner Notification is returned as undeliverable, such Winner will be disqualified and will be deemed to have forfeited his/her prize. It is the sole responsibility of an entrant to notify Sponsor of any changes in his/her name and/or address. Each winning entrant must sign and return any documents, if requested, within the time period stipulated by the Sponsor. Failure to comply with this requirement may result in disqualification. Any notification returned as undeliverable may result in disqualification and the prize will be awarded to another entrant. A list of the winner(s) will be provided upon request. If you are a selected as a winner, your information may be included in a publicly-available winner’s list, available after ten (10) business days after the end of the Contest Period from Sponsor upon e-mail request (sent to hello@brit.co).
PRIZES: Two Hundred and Twenty Five Dollars (USD $225) per chosen page design.
A contest prize is non-transferable, non-redeemable for cash (if not cash) and may not be applied as a credit towards a different Sponsor offering; no prize substitution. The Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. All taxes associated with the receipt or use of a prize is the sole responsibility of a winner. Sponsor reserves the right to withhold any taxes as required by applicable law. Actual prize may differ from promotion images. Winners must look to prize manufacturer for warranty issues; Sponsor is not liable for performance of prize.
PRIVACY. Entrants agree that personal data submitted with an entry, including name, mailing address, phone number, and email address may be collected, processed, stored and otherwise used by the Sponsor and their affiliates for the purposes of conducting and administering the Contest. The Sponsor may also use your personal information to send you updates and promotional materials, including advertising, from time to time. The Entrant’s personal data may be displayed along with Entrant’s photograph on one or more of the Sponsor’s websites. If you share your entry with your Facebook or other social media site, your design may be linked to your Facebook timeline and may be visible for others to see, as permitted by your applicable privacy settings. If you “Like” a design posted to the Sponsor’s Facebook page, or if you “Like” the Sponsor’s Facebook page, Sponsor may receive information about you, including your profile information and Friends connected to you on the social network, from Facebook, as permitted by your applicable Facebook privacy settings. Please note that once information is shared on social media it may not be possible to delete it entirely. We urge you to review your social network privacy settings to learn more about how your information is shared through the social network.
DISCLAIMER AND LIMIT OF LIABILITY: SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR ENTRANT’S PARTICIPATION IN THIS CONTEST. CONTEST ENTITIES SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, COST, OR INJURY THAT ARISES FROM OR RELATES TO PARTICIPATION IN THE CONTEST, OR WINNING OR USE OF A PRIZE, INCLUDING BUT NOT LIMITED TO: (1) LATE, LOST, DELAYED, DAMAGED, MISDIRECTED, INCOMPLETE, OR UNINTELLIGIBLE ENTRIES; (2) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, OR COMPUTER MALFUNCTIONS, FAILURES, VIRUSES OR DIFFICULTIES OF ANY KIND; (3) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER TRANSMISSIONS; (4) THE UPLOADING OR DOWNLOADING OF ANY MATERIAL IN CONNECTION WITH A CONTEST; AND (5) ANY OTHER CONDITION THAT MAY CAUSE THE CONTEST TO BE DISRUPTED OR CORRUPTED. SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE, TO SUSPEND OR CANCEL THIS CONTEST OR DISQUALIFY ANY ENTRANT IF, IN ITS SOLE DISCRETION, INTEGRITY OR FAIRNESS OF THE CONTEST HAS BEEN COMPROMISED, OR ALTER THE RULES FOR ANY REASON, INCLUDING BUT NOT LIMITED TO ALTERATION OR CORRUPTION OF THE ADMINISTRATION OF THE CONTEST BY COMPUTER VIRUS, TECHNICAL PROBLEM, OR OTHER UNFORESEEABLE EVENT. THIS CONTEST IF VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW.
RELEASE BY ENTRANTS: By entering the contest, each entrant indemnifies, releases and agrees to hold harmless Sponsor and its parent, subsidiaries, affiliates, owners, attorneys, and employees from any liability whatsoever for any claims, costs, losses, or damages of any kind (including, but not limited to those related to, personal injury or death, damage to property, infringement of proprietary rights, rights of publicity, or privacy or defamation and attorneys’ fees) arising out of or in connection with: (1) entering a contest; (2) acceptance or use of any prize; or (3) any other act or omission arising out of or relating to the Contest.
As a condition of entering, entrants agree (a) to release Sponsor and each of its officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to participating in the Contest or the awarding, receipt, possession, and/or use or misuse of any prize or any travel/activity related thereto; (b) that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event will any entrant be entitled to attorneys’ fees and court costs; (f) to comply with these Contest Rules and agree to be bound by all decisions of Sponsor, acting in its sole discretion; (g) to all issues of interpretation to be decided by Sponsor; (h) all decision of Sponsor are final and binding in all matters; (i) the Contest Rules govern over all other communications.
If a dispute arises regarding who submitted an online Entry, the Entry will be deemed to be submitted by the authorized account holder of the email address provided at the time of entry and he/she must comply with these Contest Rules. Authorized account holder is defined as the natural person who is assigned to an email by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
MISCONDUCT: Sponsor reserves the right at its sole discretion to disqualify or refuse entry to any person who (i) tampers with the registration process, the operation of this Contest, including by not limited to cheating, hacking, deception, or other fraudulent, deceptive or unfair playing practices (including any entries generated by script, macro, robotic, programmed, or any other automated means or any other means which subert the entry process) or Sponsor web site; (ii) acts in an unsportsmanlike or disruptive manner, or with the intent to annoy or harass another person; or (iii) is otherwise in violation of these Contest Rules.
GOVERNING LAW: Contests shall be governed by and construed in accordance with the laws of the State of California, applicable to contracts made and performed therein without reference to conflicts of law principles. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely in San Francisco County, California. The parties consent to the jurisdiction of the federal and state courts located in the San Francisco County, California, with respect to any action, dispute, or other matter pertaining to or arising out of any contest.
INTELLECTUAL PROPERTY: Contests and all related web pages and code are the property of Sponsor. Any copying or unauthorized use of Sponsor’s copyrighted materials, trademarks or any other intellectual property without Sponsor’s express written consent is strictly prohibited.
